IAC-09-E8.2 The Place of TCBMs in the Outer Space Security Prof., Dr. Anatoly Kapustin Peoples’ Friendship University of Russia, Moscow (Russia) Abstract The main task of this paper is to stimulate discussion and thereby to define IISL position regarding the development and application of transparency and confidence-buildung measures (TCBMs) in Outer Space.. TCBMs are an integral part of the international legal framework of international security. The author of the paper argue in favour of the close relation between the issue of prevention of an arms race in Outer Space and TCBMs in Outer Space. They can play an independent role in ensuring space security and remain an integral part of the control mechanism of a treaty prohibiting the deployment of weapons in Outer Space. The drafting of a treaty prohibiting the weaponization of Outer Space should go in parallel with development of TCBMs. TCBMs, with all their importance and relevance for security in Outer Space, cannot substitute for comprehensive legal obligations on the prevention of an arms race in Outer Space. The issue of TCBMs remain valid and require continuous attention and further development. The international community has already taken steps to develop comprehensive recommendations on TCBMs in Outer Space. The big event for TCBMs progress in Outer Space have been the presentation 12 February by the EU to the Conference on Disarmament in Geneva the voluntary draft Code of conduct for space activities that Council of the EU had approved on 8-9 December last year. One of the tasks of this draft is to minimize space collisions, to take measures on space debris control and mitigation.
