- Abstract
The purpose of this paper is to identify the questions of national and international legal issues in order to achieve the commercial human spaceflight in Japan. Though there are several challenges on planning a business of human spaceflight, several concepts of spaceports are putting forward inside and outside of Japan. There are still under developing the concept of encouraging the members to promote the concept itself or developing a sub-orbital spacecraft. This situation signifies that legal discussions are tending to be neglected in this area. This paper will firstly describe the Japanese regulations applied to the airports and aircrafts and try to point out their questions to applying to suborbital spacecrafts by analyzing how these regulations are supposed to be applied. Secondly, the typical way of thinking about the issue of passengers including the liability issue will be described. It seems that Japanese legal system is much more protected for consumers rather than that of the US and this paper is going to describe the questions lying there in order to find out the way to its solution. The final object of this paper is to signify a millstone for changing the law and regulation in Japan in order to encourage the promotion of commercial human spaceflight activities in Japan by pointing out specifically what are the questions which have to be secured and what are not.
