- Abstract
The Author will discuss current Space Policy and the complications it may present to future colonization efforts. This will be achieved by differentiating between Research and Colonization missions and evaluating the methods by which these determinations are made. One document that will prove useful in this topic is the Antarctic Treaty, which outlines the use of the southern polar continent by all nations. By looking at the Antarctic Treaty, there is a basis for defining use of Property on Celestial Bodies that are already recognized as not being claimed by any Nation or State. The next step will be to assign the rights of colonies for self-governance and processes to declare their sovereignty in line with the existing and proposed regulations of establishing a self-sustaining nation as recognized by the United Nations. Both can be determined by employing the Declarative Theory of Recognition where a state must meet four criteria; have a defined territory, a permanent population, a government and the ability to enter into relations with other states.
