Use of Space Technologies for Mitigating Climate Change Induced Disasters: An Analysis of the Space Legal and Regulatory Framework of UAE and Lessons for Kuwait

- Abstract
The use and application of space technologies are no longer confined to outer space, nor is it restricted to countries who have the capabilities to develop these technologies. States are now gradually realising that space technologies can be used to ensure human security of a nation and thereby help in its development. The adverse effect of climate change and the ineffective disaster management ensuing the same, will impede the human security of a country. This has led to a rise in the number of countries venturing into the space sector. The middle-east region has been seeing an increased level space activities in recent times. UAE, adopting the region’s first National Space Law and having several policies in place, has been a pioneer in this regard. On the other hand Kuwait’s foray into the space industry with it’s first satellite launched is also making baby steps towards the right direction. This paper focuses on the use of space-based technology for effective disaster management, as the disasters that have increased in recent times due to the effect of climate change, warrants serious attention. The space technologies can help in mitigating the effects of such disasters. For example, the Early Warning System with the help of satellite telemetry is an effective measure. In its first part, the paper will analyse the existing policies and regulatory framework in UAE and evaluate if the country has been effective in using this in practice and/or if there is any lacuna in the framework. Considering Kuwait has similar geography and demography like UAE, in the second part, this paper would propose appropriate suggestions to adopt and considerations for Kuwait in order to establish an appropriate legal and regulatory framework.
