    Abstract
    With the Commercial Space Launch Amendment Act of 2004, US legislation has started to establish rules on the liability of space flight participants. This paper will compare these rules with the history of air law liability regimes.
    
    The public, as innocent bystander on the ground or as passenger on board, has a need to be protected against risks. Any resulting liability and insurance regime reflects not only risks, but also legal traditions. In this context, it needs to be seen if emerging national regimes can be the seeds for international regulation, or if future international rules will have to pursue another path.
