    Abstract
    This paper will focus on the proposed regulations on human space flight requirements for crew and space flight participants (“tourists”), now circulating for official public comment in the United States.  Under the authority of the Federal Aviation Administration, the government is attempting to create a regulatory scheme that is protective of human life and health.  The regulation includes medical certification, crew training, and financial responsibiliyt.  While some level of government oversight is necessary to ensure compliance with international obligations, the regulations must be flexible enough to allow this nascent industry to develop without unnecessary or artificially rigid barriers.  The paper will analyze the proposed regulations, as well as industry views on the impact such regulations will have on the commercial development of private launch capabilities.
