    Abstract
    The commercialization of outer space activities, emerged in the late 20th century, is currently moved toward a new era. Nevertheless, the development in legal aspects relating to intellectual property rights in outer space was unparalleled with the pace setting by commercialization, which leads to black hole and uncertainties in IPR protection that will create disincentives to private sector investment as well as public/private partnerships in space endeavors since entrepreneurs need to be encouraged with an expectable and rational payback for their investments. The paper aims to analyze the existing IPR legal regime and examine how to apply it to outer space under the circumstances that no legislation or regulation concerning IPR protection in outer space will be stipulated in a short time. Finally, the paper will provide a feasible way to resolve the IPR protection in outer space as a provisional and transitional measure.
