  • Is Selling Land on the Moon Allowed in China?

    Abstract
    A couple of years ago, a Chinese company sold land on the Moon in Beijing. The company was fined and its license was revoked by Beijing Administration for Industry and Commerce (BAIC). The company also lost a lawsuit against the decision of the BAIC. However, the Regulation which provided the legal basis for the decision on the case has been abolished since 2008. The CEO of the company is now preparing to sell land on the Moon again. This paper analyses the reasoning of the BAIC’s decision, the treaty obligation to prohibit national appropriation of outer space, including the Moon and other celestial bodies and the gap in the national law for fulfillment of  the treaty obligation.
