- Abstract
with the development of space technology and lunar exploration activities, it is urgent for international community to establish a international legal system and international regime on exploration and use of the nature resouces of the moon and other celecial bodies. Because of less state parties, the “moon agreement”has no universal binding force to international society. But the principle of the common heritage of mankind stipulated in the moon agreement has become an international custom for international space activities. The principle provided the legal foundation for establishment of a international regime on exploration and use of the nature resouces of the moon and other celecial bodies. This paper will explore a model and procedure of international regime on exploration and use of the nature resouces of the moon and other celecial bodies under the principle of the common heritage of mankind in international space law. The paper includes three parts. The first part will analysis the legal basises and theories on establishment of international regime on exploration and use of the nature resouces of the moon and other celecial bodies. Accoding to the international regime on exploration of international seabed, the second part will discribe the common natures on international regime under the principle of the common heritage of mankind. This part will analysis the applicablity of the regime to exploration of the nature resouces of the moon and other celecial bodies. The third part attempt to design a new model for international regime on exploration and use of the nature resouces of the moon and other celecial bodies. The model will include organizational structure and legal framwork on the international regime on exploration and use of the nature resouces of the moon and other celecial bodies.
