- Abstract
On 30th October 2013, aerospace law was officially incorporated by the Standing Committee of the China’s National People’s Congress into its legislation plan for the next five years. However, the related proposals so far failed to notice the significant role of national legislation in advancing commercial use of outer space. This article will argue that China should use the space legislation as an opportunity to seek and encourage the development of commercial space activities. This is fundamentally important to keep China’s space program vibrant and promote its sustainability. Moreover, the consequent less military evolvement and increasing transparency of space activities could be helpful to further broaden and deepen China’s international cooperation in this regard and to narrow down the gap between China’s intention and the perception by certain states regarding space security.
