    Abstract
    With the development of space technology and space activities, the utilization of near space will play important role in relay communication, space transportation and early warning and reconnaissance. In the framework of existing international, international air and space law can’t be applicable to the use of near space. It is essential to establish a legal regime on near space.
    The presentation will include two parts. On the one hand, it confirms that the Physical Characteristics of near space is different with that of air space and outer space, near-spacecraft is different with aircraft and space craft, so near space is an independent space which is different with air space and outer space.
    On the other hand, the exploration and use of near space can’t be subjected to the legal principle of freely use of outer space and the principle of state sovereignty. the near space can be explored and used freely by mankind, but the exploration and use of near space shall not threat the security of other states. The benefits from the exploration and use of near space shall be shared by all mankind.
